{"id":12322,"date":"2026-07-14T12:19:49","date_gmt":"2026-07-14T09:19:49","guid":{"rendered":"https:\/\/siopi-law.gr\/?p=12322"},"modified":"2026-07-14T12:19:49","modified_gmt":"2026-07-14T09:19:49","slug":"second-chance-residence-permit-eligibility-requirements-and-application-procedure","status":"publish","type":"post","link":"https:\/\/siopi-law.gr\/en\/second-chance-residence-permit-eligibility-requirements-and-application-procedure\/","title":{"rendered":"\u201cSecond Chance\u201d Residence Permit: Eligibility Requirements and Application Procedure"},"content":{"rendered":"<p>Law 5275\/2026 introduced a new category of residence permit, namely the <strong>Second Chance Residence Permit<\/strong> (Residence Permit Type I9). This residence permit is granted by decision of the Secretary of the competent Decentralized Administration and is available to third-country nationals who previously held a permanent residence permit or residence card for at least five (5) years pursuant to Law 4251\/2014 or Law 5038\/2024, provided that such permit has expired, or was issued and served after its expiry, during the last year prior to the entry into force of the aforementioned law, and was not renewed, was revoked, or whose renewal application was rejected.<\/p>\n<p>The eligibility requirements for the issuance of a Second Chance Residence Permit are the following:<\/p>\n<p>&#8211; The applicant must have held a permanent residence permit or residence card for at least five (5) years pursuant to Law 4251\/2014 or Law 5038\/2024, the validity of which expired, or which was issued and served after its expiry, during the last year prior to the entry into force of Law 5275\/2026, and which was not renewed, was revoked, or whose renewal application was rejected. It should be noted that Law 5275\/2026 entered into force on <strong>6 February 2026<\/strong>. Consequently, in order to fall within the scope of this provision, the rejection or revocation decision must have been issued after <strong>6 February 2025<\/strong> and no later than <strong>6 February 2026<\/strong>.<\/p>\n<p>&#8211; The applicant must continue to reside in Greece and must not have been absent from the country for an aggregate period exceeding six (6) months up to the date of submission of the application.<\/p>\n<p>&#8211; There must be no grounds indicating that the applicant constitutes a threat to public order or public security within the meaning of Article 8(c), and the five-year exclusion sanction provided for in Article 20(4) must not have been imposed on the applicant or, if previously imposed, must have been lifted.<\/p>\n<p>&#8211; The application for renewal of the applicant&#8217;s residence permit must have been rejected as out of time, or the renewal application must have been rejected, or the permanent residence permit must have been revoked due to failure to satisfy the statutory requirements for its renewal.<\/p>\n<p>This new provision enables third-country nationals who had completed five years of lawful residence in Greece and subsequently lost their lawful residence status (either because they failed to renew their residence permit or because their renewal application was rejected) during the last year prior to the entry into force of Law 5275\/2026 to apply for a Second Chance Residence Permit.<\/p>\n<p>The provision does not establish a specific deadline for filing the application. The only requirement is that the rejection decision or revocation, as well as its notification\/service where applicable, must have taken place during the last year before the entry into force of Law 5275\/2026.<\/p>\n<p>The application must be accompanied by an electronic fee (e-paravolo) of <strong>EUR 300<\/strong>, which is non-refundable irrespective of the outcome of the application. The applicant must also submit evidence that he or she has comprehensive health insurance covering all risks that are covered for Greek nationals. For this purpose, a private health insurance policy providing such comprehensive coverage is also considered sufficient. The Second Chance Residence Permit may be granted <strong>only once<\/strong>.
